Estate Planning |
|
A proper estate plan can provide peace of mind to you and your family. We strive to give you peace of mind by efficiently addressing all of your estate planning needs. We will meet with you, learn your objectives, offer recommendations, and customize an estate plan for your specific needs. That often consists of the preparation of your last will and testament, a durable power of attorney for your property, a health care power of attorney, and other estate planning legal strategies designed to preserve your assets and protect your family. In situations where a relative has lost the mental or physical ability to care for themselves of their business affairs, and have designated no one as their agent through a Power of Attorney, The firm will assist in the Interdiction process to have a family member appointed by the court as a curator, and provide legal assistance in the management process. If appropriate, we will assist you in planning for Veterans Assistance programs, and Medicaid assistance. Nursing home costs are staggering and can deplete assets over a short period of time. Medicaid application and qualification involves a “look back” for sixty months into your financial affairs. Some actions taken without good counsel (donating a home to family members, or “selling” a home for less than market value) can cause penalties and disqualification which can take years to overcome. The best planning is early, calm and wise. Let us help! If you recently lost a spouse, parent, or other loved one, we want to assist you with the Succession process. While the death of a loved one is difficult emotionally, there are many tax, legal, financial and family issues which should be addressed in a timely fashion. The property of a deceased loved one cannot be placed in commerce for sale, or mineral lease, until the succession process is addressed and completed. A delay in facing succession issues can also cause large problems to future generations in time, money, and lost opportunities. We seek to walk you through the estate administration process to legally place the property of your loved one in the hands of those for whom it was intended, in a timely manner, with minimum costs and reasonable fees. |
